Terms and Conditions

Effective Date: 13th August 2026

These Terms and Conditions govern the contractual relationship between Giravex Safaris (“Giravex Safaris”, “the Company”, “we”, “us” or “our”) and the person or persons making a booking (“the Client”, “you” or “your”) for safari, tour, accommodation, transportation, wildlife, cultural, adventure or other travel services arranged by the Company.

By making a booking, paying a deposit, accepting a quotation or otherwise confirming your intention to travel with Giravex Safaris, you confirm that you have read, understood and accepted these Terms and Conditions on behalf of yourself and all persons included in the booking.


1. BOOKING AND CONTRACT

1.1 A booking becomes confirmed once Giravex Safaris has received the required deposit or full payment and has issued written confirmation of the booking.

1.2 The person making the booking confirms that they have the authority to make the booking on behalf of all members of their travelling party and that all members of the party agree to be bound by these Terms and Conditions.

1.3 The booking confirmation, quotation, invoice and confirmed itinerary form part of the contract between Giravex Safaris and the Client.

1.4 No amendment to these Terms and Conditions shall be valid unless confirmed in writing by an authorised representative of Giravex Safaris.

1.5 Safari prices are generally quoted in United States Dollars (USD), unless otherwise stated. Where payment is made in Ugandan Shillings or another currency, the applicable exchange rate shall be the rate communicated by Giravex Safaris or the Company's receiving bank at the time of payment.

1.6 Unless specifically stated otherwise in the quotation, safari rates include only the services expressly listed in the confirmed itinerary and quotation.


2. SAFARI RATES AND WHAT IS INCLUDED

2.1 The inclusions and exclusions applicable to each safari shall be clearly stated in the Client's quotation or confirmed itinerary.

2.2 Unless specifically included, the following are generally excluded:

  1. International and domestic airfares
  2. Visa and entry fees
  3. Travel and medical insurance
  4. Personal expenses
  5. Alcoholic and other personal beverages
  6. Laundry services
  7. Tips and gratuities
  8. Personal shopping
  9. Optional activities not included in the itinerary
  10. Any additional accommodation or transportation arising from circumstances outside the Company's control
  11. Any other service not expressly stated as included in the quotation

2.3 Where meals are included, the applicable meal plan shall be stated in the quotation or itinerary.


3. DEPOSIT AND BOOKING CONFIRMATION

3.1 Unless otherwise agreed in writing, a 30% deposit of the total safari value is required to secure a booking.

3.2 Certain services require full payment at the time of booking because they are subject to limited availability or non refundable supplier terms. These may include, but are not limited to:

  1. Gorilla trekking permits
  2. Chimpanzee trekking permits
  3. Other wildlife permits
  4. Park fees
  5. Domestic flights
  6. Certain accommodation deposits
  7. Special event tickets
  8. Other services specifically identified as non refundable

3.3 Where such services have already been purchased on behalf of the Client, the applicable amount may be non refundable, subject to the terms of the relevant authority or supplier.

3.4 A booking is not considered secured until the required payment has been received and written confirmation has been issued by Giravex Safaris.


4. BALANCE PAYMENT

4.1 Unless otherwise agreed in writing, the remaining balance must be paid at least 30 days before the scheduled arrival or safari commencement date.

4.2 Bookings made within 30 days of the scheduled commencement date must be paid in full at the time of confirmation.

4.3 If the balance is not received by the agreed due date, Giravex Safaris reserves the right to cancel the booking after giving reasonable notice to the Client.

4.4 Giravex Safaris shall not be responsible for any loss of availability, price increases, cancellation charges or additional costs arising from delayed payment by the Client.

4.5 All bank charges, international transfer fees, intermediary bank charges and payment processing charges associated with payments to Giravex Safaris shall be borne by the Client unless otherwise agreed.


5. PAYMENT METHODS

5.1 Payment may be made using the payment method communicated by Giravex Safaris, including bank transfer or other approved payment methods.

5.2 Bank details and payment instructions shall be provided to the Client upon confirmation of the booking.

5.3 Clients are advised to verify payment instructions directly with Giravex Safaris before making a transfer, particularly where bank details have changed.


6. CANCELLATION BY THE CLIENT

6.1 All cancellations must be submitted to Giravex Safaris in writing.

6.2 The cancellation date shall be the date on which the written cancellation is received by Giravex Safaris.

6.3 Unless otherwise stated in the booking confirmation, the following cancellation charges shall apply:

6.4 The above cancellation charges may be higher where third party suppliers impose non refundable charges.

6.5 Gorilla permits, chimpanzee permits, park fees, domestic flights, accommodation deposits and other services already paid for on behalf of the Client shall be subject to the cancellation and refund conditions of the relevant authority or supplier.

6.6 Any refund due to the Client shall be processed after deduction of applicable cancellation charges, non refundable supplier costs, bank charges and other costs legitimately incurred by Giravex Safaris on behalf of the Client.

6.7 No refund shall normally be made for services that the Client voluntarily chooses not to use after the safari has commenced, including unused accommodation, meals, activities, transportation or excursions.



7. CANCELLATION OR CHANGES BY GIRAVEX SAFARIS

7.1 Giravex Safaris reserves the right to cancel, postpone, modify or alter a safari or any part of the itinerary where circumstances make it unsafe, impractical or impossible to operate the safari as originally planned.

7.2 Such circumstances may include, but are not limited to:

  1. Extreme or adverse weather conditions
  2. Natural disasters
  3. Civil unrest
  4. War or threat of war
  5. Terrorism or security threats
  6. Government restrictions or changes in regulations
  7. Road closures
  8. Closure of national parks or protected areas
  9. Disease outbreaks or public health restrictions
  10. Strikes or industrial action
  11. Failure or cancellation by airlines, accommodation providers or other suppliers
  12. Mechanical failure
  13. Changes imposed by wildlife authorities or government agencies
  14. Other circumstances beyond the reasonable control of Giravex Safaris

7.3 Where reasonably possible, Giravex Safaris shall offer an alternative arrangement of comparable standard.

7.4 If the Company cancels a safari before departure and no suitable alternative can reasonably be provided, Giravex Safaris shall refund amounts received for services that have not already been committed to or paid to third party suppliers, subject to applicable supplier cancellation terms.

7.5 Giravex Safaris shall not be liable for additional expenses incurred by the Client as a result of circumstances beyond the Company's reasonable control.



8. CHANGES OR ALTERATIONS REQUESTED BY THE CLIENT

8.1 Giravex Safaris shall make reasonable efforts to accommodate requests for changes to a confirmed itinerary.

8.2 All requests for changes must be made in writing and must be confirmed in writing by Giravex Safaris before they become effective.

8.3 Changes may result in additional costs, including supplier amendment fees, accommodation rate differences, transportation costs, administration charges and other expenses.

8.4 Where a Client requests a change that results in a reduction in the number of travellers, reduction in accommodation nights, removal of activities or shortening of the itinerary, the Company shall recalculate the cost based on the terms offered by its suppliers.

8.5 Changes requested within 30 days of departure may be subject to additional charges and cannot be guaranteed.

8.6 Where a Client wishes to transfer a booking to another person, Giravex Safaris may permit such transfer subject to availability, supplier conditions and the replacement traveller meeting all applicable travel requirements.



9. CHANGES MADE BY GIRAVEX SAFARIS

9.1 Safari itineraries may occasionally require operational changes.

9.2 Where accommodation becomes unavailable, Giravex Safaris may substitute it with another property of a similar or higher standard, preferably within the same area or destination.

9.3 Where an equivalent alternative is unavailable, the Company shall communicate the proposed alternative to the Client and make reasonable efforts to minimise any inconvenience.

9.4 Changes may also be necessary due to park regulations, wildlife movements, road conditions, weather, conservation requirements, supplier availability or other operational circumstances.

9.5 Safari itineraries are planned carefully but are not guarantees of specific wildlife sightings, exact travel times or uninterrupted access to every attraction listed.



10. PRICE AND FARE VARIATIONS

10.1 Once a safari has been confirmed, Giravex Safaris will endeavour to maintain the agreed price.

10.2 However, the Company reserves the right to adjust the price where significant increases occur in costs beyond its reasonable control, including:

  1. National park and conservation fees
  2. Gorilla or chimpanzee permit charges
  3. Government taxes
  4. Accommodation rates
  5. Airline or fuel charges
  6. Exchange rate fluctuations
  7. New government charges or levies
  8. Supplier price increases
  9. Other mandatory charges introduced after the booking was confirmed

10.3 Where a significant price increase is unavoidable, Giravex Safaris shall communicate the increase to the Client as soon as reasonably possible.

10.4 The Client shall be given reasonable information concerning the reason for the additional charge before the Company requires payment.



11. PASSPORTS, VISAS AND TRAVEL DOCUMENTS

11.1 The Client is solely responsible for ensuring that they possess valid passports, visas, permits, travel insurance, vaccination certificates and any other documents required for entry into Uganda or any other country included in the itinerary.

11.2 Passports should generally have sufficient validity beyond the intended date of travel as required by the relevant immigration authorities.

11.3 Giravex Safaris may provide general guidance concerning travel documentation but shall not be responsible for a Client's failure to obtain or maintain the required documentation.

11.4 The Company shall not be responsible for losses arising from denied boarding, refused entry, visa refusal, expired travel documents or failure to comply with immigration requirements.



12. TRAVEL INSURANCE

12.1 Giravex Safaris strongly recommends that all Clients obtain comprehensive travel insurance before travelling.

12.2 Travel insurance should, where applicable, cover:

  1. Medical expenses
  2. Emergency evacuation
  3. Trip cancellation
  4. Trip interruption
  5. Lost or stolen baggage
  6. Personal belongings
  7. Travel delays
  8. Personal liability
  9. Other risks associated with the Client's itinerary

12.3 Clients participating in adventure activities, trekking or wildlife experiences are responsible for ensuring that their insurance policy covers the activities they intend to undertake.

12.4 Giravex Safaris shall not be responsible for costs that could reasonably have been covered by appropriate travel insurance.



13. CLIENT HEALTH, FITNESS AND SAFETY

13.1 The Client acknowledges that safaris may involve long journeys, rough roads, walking, trekking, changes in altitude, remote locations, wildlife encounters, outdoor activities and other conditions that may present inherent risks.

13.2 Clients are responsible for informing Giravex Safaris of any relevant dietary requirements, mobility limitations, allergies or other conditions that may affect the delivery of the safari.

13.3 Clients must follow reasonable safety instructions provided by Giravex Safaris, guides, drivers, accommodation providers, park authorities and activity operators.

13.4 Clients must not engage in behaviour that places themselves, other travellers, guides, drivers, staff, wildlife or property at unreasonable risk.

13.5 Giravex Safaris reserves the right to restrict participation in an activity where, in the reasonable opinion of the Company, the Client's condition or conduct presents a serious safety risk.


14. WILDLIFE AND TREKKING ACTIVITIES

14.1 Wildlife activities are conducted in natural environments and sightings of specific animals cannot be guaranteed.

14.2 Gorilla, chimpanzee and other wildlife encounters are subject to the rules, regulations and decisions of the relevant wildlife authorities.

14.3 Clients must comply with all instructions issued by park rangers, guides and wildlife authorities.

14.4 The Company shall not be liable for changes to trekking routes, wildlife viewing opportunities, access restrictions or activity schedules imposed by wildlife authorities for conservation, safety or operational reasons.

14.5 Clients participate in wildlife and adventure activities at their own risk, subject to applicable law and the responsibilities of Giravex Safaris and its contracted suppliers.


15. ACCOMMODATION

15.1 Accommodation shall be provided according to the category and property confirmed in the Client's itinerary.

15.2 Accommodation establishments may occasionally change due to availability, operational requirements, overbooking, closure or circumstances beyond the Company's reasonable control.

15.3 Where a change is necessary, Giravex Safaris shall endeavour to provide accommodation of a comparable or higher standard.

15.4 Hotel and lodge facilities, room configurations, meal services and other amenities are subject to the individual property's terms and operating conditions.

15.5 Requests for specific rooms, beds, views, adjoining rooms or other special arrangements are subject to availability and cannot be guaranteed unless expressly confirmed in writing.


16. CHILD POLICY

16.1 Child rates vary depending on the accommodation provider, destination and activity.

16.2 Unless otherwise specified in the Client's quotation, the applicable child rates and age categories shall be stated in the booking confirmation.

16.3 Certain activities, trekking experiences and accommodation facilities may impose minimum age requirements.

16.4 Parents or guardians remain responsible for children throughout the safari and must ensure that children comply with safety instructions.

 

 

17. CLIENT PROPERTY AND PERSONAL BELONGINGS

17.1 Clients are responsible for their personal belongings, travel documents, valuables and electronic equipment throughout the safari.

17.2 Clients should take reasonable precautions to safeguard valuables and should use available hotel or lodge security facilities where appropriate.

17.3 Giravex Safaris shall not be responsible for loss or damage to personal property except to the extent that such responsibility arises under applicable law or from the proven negligence or wilful misconduct of the Company or its employees.

17.4 Lost property found by the Company shall be handled in accordance with the Company's reasonable procedures, and any costs associated with returning the property shall normally be borne by the Client.


18. CLIENT CONDUCT

18.1 Clients are expected to behave respectfully towards fellow travellers, local communities, guides, drivers, accommodation staff, wildlife and cultural sites.

18.2 Giravex Safaris reserves the right to terminate a Client's participation in a safari where their conduct is seriously disruptive, abusive, threatening, unlawful or creates a significant risk to themselves or others.

18.3 In such circumstances, the Client may be required to leave the safari or accommodation at their own expense and may not be entitled to a refund for unused services.


19. SPECIAL REQUESTS

19.1 Clients with special requests should communicate them to Giravex Safaris at the time of booking.

19.2 The Company shall make reasonable efforts to accommodate special requests but cannot guarantee them unless they have been expressly confirmed in writing.

19.3 Special requests may include dietary requirements, room preferences, accessibility arrangements, celebrations, honeymoon arrangements and other personal requirements.



20. COMPLAINTS

20.1 Giravex Safaris is committed to providing high quality services and encourages Clients to communicate any concerns as soon as they arise.

20.2 If a problem occurs during the safari, the Client should immediately notify the Company's representative, guide, driver or other responsible person so that reasonable steps can be taken to resolve the matter while the Client is still travelling.

20.3 Complaints that cannot be resolved during the safari should be submitted to Giravex Safaris in writing within 21 days after completion of the safari.

20.4 Complaints should provide sufficient details, including the relevant date, service, location and nature of the concern.

20.5 Giravex Safaris shall investigate legitimate complaints and respond within a reasonable period.


21. THIRD PARTY SUPPLIERS

21.1 Giravex Safaris may engage independent third party suppliers including hotels, lodges, airlines, transport companies, wildlife authorities, activity operators, guides and other service providers.

21.2 These suppliers may have their own terms and conditions, safety requirements, cancellation policies and limitations.

21.3 Where applicable, the Client agrees to comply with the reasonable terms and conditions of such suppliers.

21.4 Giravex Safaris shall exercise reasonable care when selecting and coordinating third party suppliers but shall not be responsible for circumstances caused by a supplier that are beyond the Company's reasonable control, subject to applicable law.


22. LIMITATION OF LIABILITY

22.1 Giravex Safaris shall exercise reasonable care and skill in arranging the services included in the Client's confirmed itinerary.

22.2 The Company shall not be liable for loss, delay, injury, damage, expense or inconvenience arising from circumstances beyond its reasonable control.

22.3 Nothing in these Terms and Conditions shall exclude or limit liability that cannot legally be excluded or limited under applicable law.

22.4 Giravex Safaris shall not be responsible for indirect or consequential losses arising from a Client's failure to follow reasonable instructions, failure to obtain appropriate travel insurance, loss of personal property, personal decisions or circumstances beyond the Company's reasonable control.


23. FORCE MAJEURE

23.1 Giravex Safaris shall not be considered in breach of its obligations where performance is prevented, delayed or materially affected by circumstances beyond its reasonable control.

23.2 Such circumstances may include, without limitation:

  1. War or threat of war
  2. Terrorism
  3. Civil unrest
  4. Natural disasters
  5. Floods
  6. Fire
  7. Epidemics or pandemics
  8. Government restrictions
  9. Changes in laws or regulations
  10. Strikes
  11. Labour disputes
  12. Road closures
  13. Airport closures
  14. Severe weather
  15. Wildlife authority restrictions
  16. Security incidents
  17. Transport disruptions
  18. Acts of God
  19. Other circumstances beyond the reasonable control of the Company


24. PHOTOGRAPHY AND MEDIA

24.1 Clients are encouraged to respect the privacy and cultural practices of local communities and other travellers when taking photographs or recording video.

24.2 Photography of wildlife shall be conducted in accordance with applicable park and wildlife authority regulations.

24.3 Giravex Safaris shall not use identifiable photographs or videos of Clients for commercial marketing purposes without appropriate consent.


25. PRIVACY AND PERSONAL INFORMATION

25.1 Giravex Safaris respects the privacy and confidentiality of its Clients.

25.2 Personal information collected during the booking process may be used for purposes including:

  1. Processing and managing bookings
  2. Communicating with Clients
  3. Arranging accommodation and other travel services
  4. Meeting legal and regulatory requirements
  5. Processing payments
  6. Providing customer support
  7. Improving our services

25.3 Giravex Safaris shall take reasonable steps to protect personal information against unauthorised access, disclosure, alteration or misuse.

25.4 Personal information may be shared with relevant suppliers where reasonably necessary to deliver the services booked by the Client.

25.5 The Company's handling of personal information shall also be governed by its applicable Privacy Policy.


26. GOVERNING LAW AND DISPUTE RESOLUTION

26.1 These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Uganda, unless otherwise expressly agreed in writing.

26.2 Giravex Safaris and the Client shall endeavour to resolve any dispute arising from a booking through good faith negotiation.

26.3 Where a dispute cannot be resolved amicably, the matter may be referred to the competent courts of Uganda, subject to applicable law.


27. AMENDMENTS TO THESE TERMS AND CONDITIONS

27.1 Giravex Safaris reserves the right to update these Terms and Conditions from time to time.

27.2 The Terms and Conditions applicable to a confirmed booking shall be those provided to or accepted by the Client at the time of booking, except where changes are required by law or expressly agreed between the parties.


28. ACCEPTANCE

By confirming a booking with Giravex Safaris, the Client confirms that they have read, understood and accepted these Terms and Conditions and agree to ensure that all members of their travelling party are aware of and comply with them.
